UK same-sex partner visa visa description
If you have already registered your marriage to a UK national or for unmarried partners, if you have lived together for two years at one address, you can apply for a same-sex partner visa.
UK same-sex partner visa is issued for 2.5 years and includes the right to work. It can be extended once in the UK for 2.5 years more, then a candidate will be able to apply for ILR (Indefinite Leave to Remain) and then for UK citizenship. It is preferable to apply for a same-sex partner visa once the marriage is registered officially. There is always more chance of receiving the visa in these circumstances. However, the registration of a marriage cannot guarantee the visa will be granted. Only with the correct documents and application forms can this be assured. It is our job to make sure the documentation is accurate.
You will have to prove your marriage was registered officially or if not, for unmarried partners, you will have to show you have lived together for 2 years at the one address.
4 key requirements
Here you can find 4 main requirements for UK Same-sex partner visa applicants. Please click on icon for detailed info.
Income confirmation
The most important condition to achieve a UK Same-sex partner visa is to prove your UK partner has sufficient income. The UK partner must meet the financial requirement which is £29,000 where the applicant has no children, £32,800 with one child, £35,200 with two children, £37,600 with three children and so on. If the UK sponsor does not meet the financial requirements, and their salary is less than the amount needed, there is still the possibility of showing savings in a bank account that meets the financial requirement. This amount of savings required depends on income, and the funds must remain in the bank account for 6 months. We can count the specific amount for you and consult you on the matter. If your UK sponsor does not have a regular income in the form of a salary, they can meet the requirements by showing an amount upward of £62,500 has been kept in a bank account for six months or more.
Accommodation requirements
Another essential condition for obtaining a same-sex partner visa is the accommodation situation of the UK partner. He must occupy the accommodation solely and exclusively. If he rents accommodation in a shared house/apartment, then they should have a personal bathroom. If he lives at the accommodation with relatives, the accommodation must have enough bedrooms for everyone living at the accommodation and all the relatives should give permission for the applicant to live at the accommodation with the sponsor. We will consult you on your accommodation conditions and check if you meet all the necessary requirements.
Travel history
One more critical factor is the travel history of the applicant. It is very crucial to indicate a UK partner in previous application form for a tourist visa. The UK Embassy keeps data for 10 years, and if the applicant has not indicated UK relationships in a previous application form from 6 months ago but now states she has known the UK partner for several years, the application will be refused. This applies even if a marriage is registered officially. Not indicating a UK partner in a tourist application form may be considered as deception. It is a very common among tourist agencies to ask the applicant not to indicate a relationship in the application form as this generates lots of documents. They usually say that reporting a UK relationship will lead to a refusal. This is wrong! We know how to make the existence of a UK friend/relationship an advantage with your tourist application.
English language
You may need to prove your knowledge of the English language when you apply. You can show this with an academic qualification taught in English, or by taking a test – IELTS (International English Language Proficiency Test) life skills at A1 level. You do not need to prove this if you are applying as a national of a country where the English language is one of the official languages.
