UK Spouse Visa is issued for 2 years and 9 months and includes the right to work. It can be extended once in the UK to an ILR (Indefinite Leave to Remain) and/or UK citizenship. It is preferable to apply for a Settlement Spouse Visa once the marriage is officially registered . There is always a higher chance of receiving the visa in that case. However, registering a marriage does not guarantee that the visa will be granted. Only with the proper documents and application forms can this be assured. Proof of income

The most important requirement in being granted a UK Spouse Visa is to prove that your UK spouse has sufficient income. The UK spouse must satisfy the financial requirement of £29,000 assuming the applicant has no children; £32,800 with one child; £35,200 with two children; £37,600 with three children; and so on. If the UK sponsor does not meet the financial requirements, and their salary is less than the amount needed, there is still the option of demonstrating savings in a bank account that meets the financial requirement. This amount of savings required depends on their income and the funds must have remained in the bank account for at least 6 months. If your UK sponsor does not have a stable income in the form of a salary, they can meet the requirements by showing that an amount upwards of £62,500 has been retained in a bank account for six months or more.

Accommodation requirements

Another essential condition for obtaining a Settlement Spouse Visa is the living conditions of the UK spouse. He must occupy the accommodation solely and exclusively. If he rents his place residence in a shared house/apartment, he must have his own bathroom. If he lives at the accommodation with relatives, the accommodation must have enough bedrooms for everyone living at the accommodation and all the relatives must grant permission to the applicant living at the accommodation with the sponsor. Travel history

One more critical factor is the travel history of the applicant. It is crucial that the applicant has indicated the UK boyfriend or girlfriend in the previous application form for a tourist visa. The UK Embassy stores data for 10 years, and if the applicant did not indicate a UK relationship in a previous application form from 6 months ago but now states she has been with the UK partner several years, the application will be denied. This is true even if a marriage is officially registered. Not indicating a UK boyfriend/girlfriend in a tourist application form may be considered as fraud. It is very common among tourist agencies to ask the applicant not to indicate a relationship in the application form as this generates lots of documents. English language

You may need to prove your knowledge of the English language when you apply. You can show this using academic qualifications taught in English, or by taking a test – the IELTS (International English Language Proficiency Test) life skills and completing it at the A1 level. You do not need to prove this if you are applying as a national of a country where English is one of the official languages.

Once the application is approved, the applicant will be provided a 30-day permit to enter the UK. At the same time, a Settlement Spouse Visa will be produced in the form of a plastic BRP (Biometric Residence Permit) card in the UK.
