The UK spouse must meet the financial requirement which is £18,600 where the applicant has no children, £22,400 with one child, £24,800 with two children, £27,200 with three children and so on. If the UK sponsor does not meet the financial requirements, and their salary is less than the amount needed, there is still the possibility of showing savings in a bank account that meets the financial requirement. Another essential condition for obtaining a Settlement Spouse Visa is the accommodation situation of the UK spouse. He must occupy the accommodation solely and exclusively. If he rents accommodation in a shared house/apartment, then they should have a personal bathroom. If he lives at the accommodation with relatives, the accommodation must have enough bedrooms for everyone living at the accommodation and all the relatives should give permission for the applicant to live at the accommodation with the sponsor. One more critical factor is the travel history of the applicant. It is very crucial to indicate a UK boyfriend or girlfriend in previous application form for a tourist visa. The UK Embassy keeps data for 10 years, and if the applicant has not indicated UK relationships in a previous application form from 6 months ago but now states she has known the UK partner for several years, the application will be refused. This applies even if a marriage is registered officially. Not indicating a UK boyfriend/girlfriend in a tourist application form may be considered as deception. It is a very common among tourist agencies to ask the applicant not to indicate a relationship in the application form as this generates lots of documents. You may need to prove your knowledge of the English language when you apply. You can show this with an academic qualification taught in English, or by taking a test – IELTS (International English Language Proficiency Test) life skills at A1 level. You do not need to prove this if you are applying as a national of a country where the English language is one of the official languages.
Once the application is approved, the applicant will be provided with a 30-day permit to enter the UK. At the same time, a Settlement Spouse Visa will be produced in the form of a plastic card BRP (Biometric Residence Permit) within the UK.
